
Construction Defect - Product Fraud
In the late 1980s, Allison and her family began experiencing multiple failures in their home’s plumbing system. Leaks were springing up everywhere, with 24 major breaks in less than three years. The plumbing was made from polybutylene, a product manufactured by Shell. Allison soon found out that this product was failing in thousands of homes across the nation, and that a groundswell of class-action litigation was forming. She turned to James L Moriarty PC, who was representing several families suffering the same circumstances.
Shell and its codefendants mounted a vigorous defense, employing an army of lawyers and spending millions to fight against us and other firms who had joined the fray on behalf of these despairing homeowners. The defense came at our clients full-force, subjecting them to ruthlessly intense testimony. We stuck together and didn’t back down, and in the end the jury ruled for the homeowners. We negotiated an out-of-court settlement for all of our clients, as a result the plumbing system that was destroying Allison’s home and her family’s wellbeing was replaced. |
